Under recent changes to the Fair Work Act, union representatives in the workplace (called delegates under the legislation) will have stronger rights to represent members and non-members. The legislation took effect from 15 December 2023.
From July 2024 new enterprise agreements and all Modern Awards will be required to have specific clauses on delegates’ rights.
